Terms of use

Dualove is a dating app for adults only. These terms govern your use of the app (Android, iOS) and of the website dualove.app. Together with the Privacy policy and the Community rules, they form a single agreement. By creating an account you accept them; your acceptance is timestamped and the version you accepted is kept on record.

1. Who publishes Dualove

Dualove is published by Yannis Catounaud, sole trader under French law (micro-entreprise), registered with the French National Business Register under SIREN 821 821 345, SIRET 821 821 345 00013. Publication director: Yannis Catounaud. 2. Who can use Dualove

You are 18 or older. An account found to belong to a minor is deleted immediately and no data is kept.
You create a single account, under your real identity: your first name, your age, photos of you.
You have a phone number or an email address you control, verified with a one-time code, or an Apple or Google account.
You have never been banned from Dualove and you have the legal capacity to enter into a contract.

3. Your account

Your login code is personal. Never share it with anyone: Dualove will never ask you for it, not by message and not by phone.
You are responsible for what happens from your account and your devices. If you think it has been used without your permission, let us know right away.
You can log out of your devices from the settings. A session expires on its own after 180 days at most.
We may ask you to verify again (a code, your identity) when the safety of your account or of other people calls for it.

4. How the service works

The face-off. Each round shows two profiles near you side by side. The heart likes one of them; the other comes back later in your selection. There is no ranking, no rating and no permanent "pass".
How many face-offs. On a free account, the number of face-offs settled with a heart is capped over a rolling 24-hour period; the app shows how many are left and the time a face-off becomes available again. "Neither" does not count towards that cap. With Dualove Plus, face-offs are unlimited. The number may be adjusted; it is always shown in the app.
Matches and messages. When two people like each other, a conversation opens. Messages are only translated when you tap "Translate".
Proximity. Dualove shows you people around your approximate location or the city you choose, within 50 km at most with a free account and 200 km with Dualove Plus. Picking your city by hand is open to everyone at sign-up; changing it afterwards is part of Dualove Plus, while your phone location stays available to all.
Free, with a paid option. The core of the service is free. Dualove Plus adds the features described in section 7.
Dualove does not verify the identity of its members and runs no background checks on them. Dualove guarantees no match, no date and no outcome.
The service evolves. We may add, change or remove features and interrupt the service for maintenance; we give you reasonable notice when a significant change affects you.

5. Your content

You remain the owner of your photos, your bio and your messages.
So that Dualove can work, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt (cropping, resizing, blurring, on-demand translation) and display this content to other people, according to your settings, and to review it for moderation purposes. This license lasts as long as your account does, then only for as long as strictly necessary for moderation and for our legal obligations.
You warrant that you have the right to publish what you publish: photos of you, with no recognizable third party who has not given their consent, and no unlawful content or content that breaks the Community rules.
We may remove, blur or refuse content that breaches these terms, and we tell you when we do.
Your conversations are private. Messages attached to a report may be read by our moderation team.

6. Community rules

Three rules, zero exceptions: respect, authenticity, no explicit or commercial content. They are detailed in the Community rules, which you accept when you sign up. Breaking them leads to the measures described in section 8.

7. Dualove Plus

Dualove Plus is an optional subscription, purchased and billed through the App Store (Apple) or Google Play (Google). The price, currency, duration and trial conditions are shown before you buy. It is Dualove's only source of revenue.
For the length of your subscription, it gives you: unlimited face-offs, a search radius of up to 200 km, the list of people who liked you, the option to revisit the last face-off you decided, once, and the ability to pick your city by hand after sign-up. These features may evolve; if one of them were substantially removed, you could cancel.
The subscription renews automatically at the end of each period, at the price then in force, unless you cancel at least 24 hours before the renewal date from your store's subscription settings. It stays active until the end of the paid period.
When a free trial is offered, it turns into a paid subscription when it ends unless you cancel before then. One trial per account.
Refunds and right of withdrawal. Refund requests are handled by the store under its own rules. If you live in the European Union, you have a 14-day right of withdrawal; by asking for immediate access to Dualove Plus, you agree that the service starts right away and you waive that right for the period that has begun, to the extent permitted by law.
A price change is notified to you in advance by the store; it only applies from the next renewal, and you can cancel before then.
Deleting your account does not cancel the subscription: remember to cancel it in your store.

8. Reports, sanctions and appeals

You can report a profile or a conversation and block someone at any time. The person reported or blocked is never told.
Every report is reviewed by a person, normally within 24 hours, with the last messages of the conversation attached automatically.
Depending on severity, we may issue a warning, restrict messaging, suspend the account for a set period or ban it permanently. The zero-tolerance cases described in the Community rules lead to an immediate ban.
Every measure is notified to you with its reason. You can appeal it from the app ("Appeal the decision") or by email; another member of the team reviews the case and gets back to you.
Manifestly unlawful content may be passed on to the competent authorities, together with the data they need. Point of contact for authorities and for reports of unlawful content: hello@dualove.app.

9. Deleting your account, end of the contract

You can delete your account at any time from the settings. Your profile disappears immediately. For 30 days, simply logging back in cancels the deletion. After that, your photos, messages, likes and matches are erased and your account is anonymized; this cannot be undone.
We keep only what the law or moderation requires: the snapshots attached to reports and the history of sanctions.
We may suspend or close your account if you breach these terms or the Community rules, immediately in zero-tolerance cases and otherwise after notifying you. Amounts paid to the store for the current period follow the store's refund rules.

10. Intellectual property

Dualove, its name, its logo, its interface, its texts and its code are protected. We grant you a personal, non-exclusive and non-transferable license to use the app on your devices, for private use.
You may not copy, decompile or modify the app, use bots, scripts or automation tools, extract or collect other people's data, or resell or commercially exploit the service.

11. Liability

You alone are responsible for your exchanges and your dates. Read our Safer dating tips, stay careful and report any unusual behavior.
Dualove is provided as is, with the reasonable care of a professional. We are not liable for the content and behavior of other people, for third-party services (stores, networks, connectivity providers) or for interruptions beyond our control.
To the extent permitted by law, our liability under these terms is limited to the amounts you have paid us over the last twelve months. Nothing here limits your mandatory consumer rights or our liability for gross negligence, willful misconduct or personal injury.

12. Personal data

How we process your data is described in the Privacy policy, which forms part of these terms.

13. Changes to these terms

We may update these terms. Significant changes are announced in the app or by email with reasonable notice, and you may be asked to accept them again. If you disagree, you can delete your account; continuing to use Dualove after the changes take effect counts as acceptance.

14. Governing law and disputes

These terms are governed by French law. If you live in another European Union country, in the United Kingdom or in Switzerland, you keep the protection of the mandatory rules of your country of residence.
If there is a disagreement, write to us first: most issues are resolved with support, which answers in French, English, Spanish, German and Italian. Refund requests are handled by the store the purchase was made through.
We do not take part in dispute resolution proceedings before a consumer arbitration board.
Failing an agreement, the competent courts are those designated by law.

15. App stores

The app is distributed through the App Store and Google Play. Apple and Google are not parties to these terms and have no maintenance or support obligation towards you; we alone are responsible for the app.
You confirm that you are not located in a country under embargo and that you are not on any list of restricted persons. You comply with the terms of the stores and of the third-party services you use with Dualove.
Apple and its subsidiaries are third-party beneficiaries of these terms for apps downloaded from the App Store and may enforce them in that capacity.
